Florida law provides broad protections to property owners, and one of the most important of those protections is the payment of the owners’ fees and costs in addition to the compensation the owner receives for the taking. The Florida Constitution says that a property owner has a right to receive “full” compensation, which the Florida Supreme Court has further defined to include the payment of attorneys’ fees and costs. This means that you, the owner, will not pay any out-of-pocket money in order to prepare your defense. At Bonifield Law, we accept whatever amount the court concludes is reasonable as our fee. The fees and costs associated with defending your case are completely paid by the government authority that is taking your property, and they are paid in addition to the compensation for your property and any damages.
There is no reason that you should not have an attorney look at your eminent domain case.
